These terms and conditions apply to all customer-consumer orders with ICOOLA on the ICOOLA website. If you are not a customer-consumer, please contact us at [email protected].

By placing an order, you agree to be bound by these terms and conditions. Be sure to read these terms and conditions carefully before ordering products or services.

1. Definition

  • "ICOOLA" refers to the company ICOOLA (IČ / Reg. Nr: 65414667. Moskevska 1111/1c, 73601 Havirov. Czech Republic, )
  • "You" refers to the customer ordering on the ICOOLA website.
  • “Terms” refers to these terms and conditions.
  • “ICOOLA Warranty” refers to the commercial warranty provided by ICOOLA for its phones.
  • < li>"Day" refers to a business day. Weekends and public holidays are not considered business days.
  • "FMI" refers to the Find My iPhone feature on Apple iPhones.
  • "IMEI" refers to International Mobile Equipment Identity .

2. Customer

By placing an order on the ICOOLA website, you agree to be bound by these Terms. When ordering, you are required to provide your full contact details, including your name, billing and delivery address, active phone number and email address. You are solely responsible for the accuracy of the information you provide to ICOOLA and are responsible for any costs incurred as a result of providing incorrect contact information.

By placing an order on the ICOOLA website, you confirm that you are of the required legal age and may be bound by these Terms and conditions and order on the ICOOLA website.

Customer data is stored in ICOOLA's customer register and is used to maintain and manage customer relationships. More information on the processing of personal data can be found in ICOOLA's Privacy Policy, which is available on ICOOLA's website.

3. Products

ICOOLA sells used and refurbished mobile phones. Mobile phones are checked and refurbished by ICOOLA experts before being put on sale. ICOOLA sorts mobile phones based on their aesthetic condition. When ordering, you choose the model, color, memory capacity and condition category of the mobile phone you want to buy. The mobile phones are used and have been refurbished, therefore ICOOLA cannot guarantee that the original level of water, splash and dust resistance (IP67 or IP68 certification) will be maintained.

High quality parts are used for repairs and replacements, and including third party parts. For more information about your device, contact our customer service. All repairs and modifications are done to refurbish the phone to make it work like a new phone.

ICOOLA also sells mobile phone accessories such as tempered glass or cases.

We make every reasonable effort to accurately explain the attributes of our products, including their condition and colors.

4. Prices

Product prices include value added tax (VAT) where applicable. Used mobile phones are often subject to a profit margin tax regime.

Product prices do not include delivery charges. Delivery costs are clearly stated before ordering and depend on the delivery method used.

ICOOLA reserves the right to cancel an order in the event of a clear and serious error in the price. This refers to a potential pricing error where the price of a product is so significantly and clearly different from the product's normal price level that the average consumer is deemed to understand the error.

5. Payment

ICOOLA accepts the following payment methods:

  • Payment cards (credit, debit)
  • PayPal

Purchases made through their services are subject to the terms and conditions of each of these payment providers. ICOOLA reserves the right to refuse or cancel any order. Furthermore, in case of payment problems on your end, ICOOLA reserves the right to cancel the sale and demand the immediate return of the products.

6. Delivery

The current list of shipping methods can be found on the ICOOLA website. It is your responsibility to provide ICOOLA and the shipping provider with the correct information for successful delivery, such as your address and phone number in the correct format, when ordering.

Order processing time is on average 0-1 business days after automatic order confirmation is sent. Shipping time is usually 1-5 business days.

Delivery times are approximate and depend on the logistics provider. ICOOLA aims to process, if possible, all orders within the above framework. However, ICOOLA shall not be liable for any delay in delivery beyond its reasonable control, such as due to incorrect information provided by you when ordering, strikes, weather conditions, epidemics, quarantine or lack of fuel, power or labor for transportation.

In the event that you receive an incorrect or damaged product, you must notify ICOOLA of this error within 72 hours of receiving the products. ICOOLA reserves the right to require additional payment when returning incorrect or damaged products.

7. Returning goods

By law, you have the right to return goods within 14 days. ICOOLA guarantees a full refund for returned products as long as all products are returned in the same condition as when you received them. If the products are damaged in any way, ICOOLA will either return the products to you or offer a paid repair.

ICOOLA will refund the money using the same payment method used for payment as soon as possible, no later than 5 days after receiving your products. In some cases, such as during public holidays or for other reasons, the refund process may take longer. If ICOOLA is unable to issue a refund using the same payment method used for payment, the refund will be made using an alternative method acceptable to you.

Before sending the products to ICOOLA, you are required to carefully package them so that to be protected. Products must be sent to us at the address specified in the instructions by the delivery service specified. You are responsible for the products until they are delivered to ICOOLA.

If Find My iPhone is turned on when ICOOLA receives the phone, refunds may be delayed. In addition, ICOOLA reserves the right to charge you additional delivery and/or service costs. ICOOLA reserves the right to return the phone to you if you do not turn off Find My iPhone within one (1) month after ICOOLA contacts you. In this case, ICOOLA will send the device back to you and not pay you for it. If you do not collect the phone, we take no further responsibility for the device and the device will be disposed of.

8. Liability for defects

You have a statutory warranty of 1 year from the date of delivery of the product. In the event that you discover defects in the products that existed at the time you received the products and are not the result of mishandling the products, you must inform ICOOLA of them as soon as possible after they are discovered. You can use the contact form in our Help Center, telephone or chat on the ICOOLA website to inform ICOOLA. After notification and instructions on how to proceed, you must send the defective product to us within a reasonable time to the address specified in the instructions by the specified delivery service.

If you receive a product that does not conform to the specifications, please notify us within three ( 3) days after receiving the product.

ICOOLA reserves the right to verify product defects reported and this process must always take 3-5 business days before any refunds are issued.

9. ICOOLA Warranty™

ICOOLA provides a 12-month ICOOLA Warranty™ on all phones. All detected defects covered by the ICOOLA Warranty™ will be repaired by ICOOLA. These warranty conditions separately list the cases in which the ICOOLA Warranty™ does not apply and those parts of the phone that are not covered by the ICOOLA Warranty™. The ICOOLA warranty does not apply to accessories.

The period of validity of the ICOOLA Warranty™ is 12 months from the date of purchase. It is your responsibility to familiarize yourself with these phone warranty conditions before you start using the phone.

The following services are included in our warranty:

  • Guaranteed quick repair. After receiving the phone, we will start the repair process within 24 hours.
  • Replacement device. If we are unable to return the phone to its previous state, we will replace it with another piece of the same model and aesthetic condition.
  • If we find that you caused the phone malfunction, ICOOLA will not be held responsible for it. These cases include, for example, causing physical damage to the phone, using the phone contrary to the instructions or other negligent actions. Please note the following in particular:
  • Normal wear and tear of the phone is not covered by the ICOOLA Warranty™.
  • Breakage or cracking of the screen is not covered by the ICOOLA Warranty™.
  • software defects are not covered by the ICOOLA Warranty™.
  • The removal of viruses or other malware from the phone is not covered by the ICOOLA Warranty™.
  • Damage to the phone caused by not following the instructions or related to inappropriate or unusual using the phone will void the ICOOLA Warranty™.
  • If the phone is physically opened, the ICOOLA Warranty™ will become void.
  • Damage to the phone during transportation due to your carelessness is not covered by the ICOOLA Warranty™. You are responsible for packing the phone properly for shipping.
  • The ICOOLA Warranty™ will be void if the phone serial number or IMEI has been removed or otherwise defaced.
  • For other indirect or purely financial damages caused by breaking the phone, such as destroying or corrupting data files, the ICOOLA Warranty™ is not covered.
  • The ICOOLA Warranty™ will be void if the glass / home button / camera / other functions are damaged due to improper or unusual use, such as dropping the phone or bumping the phone against another object.
  • The ICOOLA Warranty™ is void if the phone purchased from ICOOLA is repaired by the customer himself or a third party without the written consent of ICOOLA.

  • The ICOOLA Warranty™ is void if the phone is bent, damaged by water, or if any of its functions are damaged due to misuse, such as dropping the phone or striking the phone against another object.

If you receive a replacement device, the ICOOLA Warranty™ continues from the original date of purchase. If you sell the phone to a new owner during the warranty period, you must notify ICOOLA of the change of ownership so that the new owner can also be entitled to the ICOOLA Warranty™. The warranty extension is non-transferable and applies only to you as the original purchaser.

ICOOLA reserves the right to charge a delivery charge of €25 in cases where you knew or should have known that the warranty is not valid or the FMI function is enabled. Furthermore, ICOOLA reserves the right to request photos of the phone before sending it in for warranty repair.

These warranty conditions also apply to the extended 3-year warranty. The extended 3-year warranty starts from the date of purchase.

10. Limitation of liability

Nothing in these Terms shall exclude or limit the liability of ICOOLA in respect of any matter in respect of which it would be unlawful for us to limit or exclude our liability.

Products are sold as they are. ICOOLA is not liable for any indirect costs incidental to the main loss or damage, such as loss of profit or loss of opportunity, or for non-delivery of products or non-performance of our other obligations under these Terms where such non-performance is the result of an event beyond our reasonable control, including but not limited to fire, flood, storm, insurrection, civil unrest, war, nuclear accident, terrorist activity, strikes, epidemic or quarantine. ICOOLA's maximum liability to you for any loss or damage arising in connection with your order on the ICOOLA website will be limited to the total price of your order.

Liability for product defects is limited to a possible refund of the purchase price of the product after deduction benefits obtained.

ICOOLA does not provide original purchase documents from the original owner of the phone and is not obliged to do so.

Some features or services available on a phone sold by ICOOLA may require opening an Apple user account (including setting up a user's Apple ID and password). You are responsible for all activity that occurs on your account and for the security of your account information, including your password. You are prohibited from using someone else's Apple ID, password, or account without the permission and consent of the account owner. ICOOLA cannot accept and will not accept any liability for loss or damage that results from failure to comply with these obligations. ICOOLA is not responsible for forgotten Apple IDs or passwords. In cases where ICOOLA cannot access the phone for repair or refund you due to a forgotten Apple ID or password, the phone will be returned to you.

If there are unforeseen stock issues due to reasons beyond our control , ICOOLA reserves the right to cancel the sale. In this case, you will be refunded the full amount of your order.

11. Changes to Terms and Conditions

We reserve the right to change these Terms and Conditions from time to time without prior notice. The version of the Conditions that was on the ICOOLA website at the time of the order will apply to your order..

12. Applicable law and dispute resolution

These Terms are governed by the laws of the Czech Republic. In the event of a complaint, contact ICOOLA at [email protected] or +420 228 889 365. If you are not satisfied with the handling of your complaint by ICOOLA, you can file a complaint with local consumer protection agency. Or you can file a complaint on the European Union online consumer dispute resolution portal.
